FlyToFlea – General Terms and Conditions of Sale
Preamble:

The Website FlyToFlea.com is edited by the company FlyToFlea, a Société par actions simplifiée with a capital of € 10,000, whose head office is at 15, roundabout André Malraux. 92100. Boulogne-Billancourt, and registered in the Nanterre trade and companies register under the number: 832 124 374.
By confirming his order, the Customer declares that he accepts without reserve the terms of the entirety of the present general conditions of sale.
The Terms and Conditions may be subject to changes and updates. They are permanently accessible from the homepage of the Website. Each Order placed on the Website is subject to the Terms and Conditions in force on the day of the Order.

Article 1 - Definitions

The following terms, whether used in singular or in plural in these GTCS, will have the following definition:

To place an Order, the Customer must follow the purchase process of the Website.
The Customer expressly undertakes to provide complete and accurate information. In case of error in the wording of the delivery address or incomplete information making it impossible to deliver an order, the company FlyToFlea can not be held responsible.
Upon acceptance of the Customer's payment, the Customer will receive an email confirming his Order, and summarizing all items ordered, the billing address and delivery.
The validation of the Order by the Customer and the confirmation of Order sent to the Customer by email by FlyToFlea following the acceptance of the payment are considered as a sales contract between FlyToFlea and the Customer.
FlyToFlea has the right not to validate an Order for legitimate reasons such as in particular: abnormal or abusive claims, Abnormal orders with regard to the quantities ordered, exchanges and abnormal or abusive returns.
The Customer Service is at the Customer's disposal for any questions relating to the Orders. The customer service is available by email at contact@flytoflea.com or on the phone +33 (0) 6 20 55 34 87, from Monday to Friday, from 10:00 to 19:00 (time zone GMT +1 hour and except holidays in France).

Article 4 - Prices and methods of payment

The prices of the Products are indicated on the Website in euros (€) and include all taxes (VAT included) including VAT and any discounts applicable on the day of the Order.
Customer may choose to display prices in US dollars ($). The exchange rates used for the EUR / USD conversion are those set by the European Central Bank and are updated daily (24-hour period).
USD prices are shown for information only. The payment will always be made in EUR.
FlyToFlea is not responsible for the differences caused by the difference between the EUR / USD exchange rates used by FlyToFlea and the exchange rates used by the banks involved in the transaction.
The prices quoted do not include the delivery costs which will be charged in supplement. The delivery costs are communicated to the Customer on the summary of the order before the validation of the latter and are expressed inclusive of all taxes (value-added tax applicable in France).These costs are charged in addition to the price of the Products.
Some Products offered on the platform can’t be ordered online on the FlytoFlea Sales Area. In this case, the Customer is informed in advance on the Product sheet and is invited to contact FlyToFlea directly to order by phone or email.
FlyToFlea has the right to modify its selling prices at any time but agrees to apply the rates in effect on the Site at the time of validation of each Order.
The total price of the order (all taxes and shipping costs included) must be paid in full at the time of validation of the order by the Customer.
Payment is made online using one of the following payment methods: Carte Bleue, Visa, MasterCard, Amex or PayPal. Transactions made on the Site are made through the secure online payment platform: Shopify.com.
In the case of Products that can’t be ordered on the Website, payment can be made by one of the following payment methods: Carte Bleue, Visa, MasterCard, Amex, PayPal. The payment can be done in a secure way by phone or by interbank transfer.

Article 5 - Delivery

FlyToFlea undertakes to make its best efforts to deliver the products ordered within the time indicated when confirming the Order. In order to meet these deadlines, the Customer must ensure that he has provided accurate and complete information regarding the delivery address.
Any Order registered on the Website from Monday to Friday before 3 pm (time zone GMT +1 hour) will be processed the same day; after 15 hours (time zone GMT + 1 hour and holidays in France), it will be processed the next day. Any Order placed on Friday after 3 pm, Saturday and Sunday will be processed on the following Monday; being specified that Orders placed on a public holiday will be processed the next working day.
Products sold on the Website may only be delivered in the following countries: Metropolitan France, Monaco, United Kingdom, United States of America.
Deliveries are provided by La Poste services for France and the United Kingdom, and by UPS for the United States of America according to the option chosen by the Customer when validating his order.
Delivery times vary depending on the availability of the products ordered, the place of delivery and the delivery method chosen.
Les produits commandés sur le Site resteront la propriété de FlyToFlea jusqu’à leur livraison à l’adresse indiquée par le Client. Tous les risques liés aux produits commandés (y compris les risques de perte et/ou d’endommagement des produits) seront transférés au Client au moment de leur livraison.
The Products ordered on the Website will remain the property of FlyToFlea until their delivery to the address indicated by the Customer. All risks related to the products ordered (including the risk of loss and / or damage to the products) will be transferred to the Customer at the time of delivery. For orders outside France, when the parcel destined for export reaches its destination, it will be the Customer's responsibility to pay the taxes or customs duties that apply to the country of destination.

Article 6 - Complaints, returns

The Customer is required to check the conformity of the products received at the time of delivery. Any anomaly concerning the delivery such as: damaged parcel, missing products, deteriorated products, products not conforming to the order, will have to be notified within ten (10) working days following the reception of the order.
This notification will be sent to the Customer Service of FlytoFlea to the following adress:

After this period, and except hidden defect, no claim will be accepted by FlyToFlea, the products then being considered as compliant.
For any non-compliant product return, the Customer must respect the following procedure:

The products must be returned in their original packaging, with their label and any accessories allowing their new marketing, to the following address:

The risks and return costs are the sole responsibility of the Customer.
When non-compliance has been found, FlyToFlea will propose to the Customer either:
- The replacement of the product (s) at the expense of FlyToFlea, either
- The refund of the price of the order (price of products and delivery costs) as well as the costs of return of the non-compliant product no later than thirty (30) days from the acceptance by FlyToFlea of the non-conformity.
In case of refund, FlyToFlea will refund all the prices of non-compliant Products, as well as shipping costs incurred, with the exception of taxes and customs duties paid by the Customer upon delivery.

Article 7 - Right of withdrawal

The Customer has a period of fourteen (14) calendar days from the date of receipt of his Order, to return all or part of the products ordered without justification or penalty.
For any return under the right of withdrawal, the following procedure must be fully respected:

The risks and return costs are the sole responsibility of the Customer.
Subject to the above conditions, FlyToFlea will refund the amount of the Order to the Customer (price of the returned product, or price of the product and delivery charges in the case of an order returned in full) and standard delivery charges. The Client's bank account will be credited with the corresponding amount, within thirty (30) days of receipt of the products by FlyToFlea.

Article 8 - Force majeure

FlyToFlea will not be held responsible for any defect, delay or non-fulfillment of its obligations under the GTC, when this defect, delay or non-performance is related to a case of force majeure, as defined by article 1218 of the French Civil Code and more generally by the jurisprudence of the French Courts.
In such case, FlyToFlea will inform the Customer of the occurrence of the event within a period of three (3) working days following its occurrence, by e-mail.
After a period of thirty (30) days, and in the event that the force majeure persists, the Order will be canceled and will, if necessary, be subject to a refund by FlyToFlea on the credit card used to place the Order within a maximum period of thirty (30) days.

Article 9 - Limitation of Liability

The placing of an Order on the Website implies the knowledge and the acceptance of the procedures in force on the Internet network in particular as regards the technical performances, the times of answer, connection, the interrogations or transfers of information, the risks of cut, the risks of contamination by viruses circulating on the network and in general all the risks related to the use of the Internet network.
FlyToFlea can not in any way be held responsible for any direct or indirect damage resulting from misuse or incident related to the use of the computer, access to the Internet, maintenance or malfunction of servers, the telephone line or any other technical connection. The connection of the Customer to the Website is at his own responsibility.

Article 10 - Intellectual property of the contents of FlyToFlea
Article 11 - Anti-corruption rules

- Neither FlyToFlea, nor its officers, employees, associates, agents, subcontractors or any other third party acting on its behalf have committed or will commit any act of bribery against any of the officers, employees, partners, agents, subcontractors of the Customers.
- FlyToFlea has put in place and will maintain adequate anti-corruption rules and controls to prevent and detect acts of corruption within its organization, whether these are carried out by its directors, employees, partners, agents, under processors, or any other third party acting on its behalf.
- FlyToFlea or its related parties do not occupy a position of civil servant (any agent or employee of any government or agency, ministry, government department) or any other function that may exert an illegal influence on behalf of the Customers or affiliated companies.

Article 12 - Personal data

FlyToFlea undertakes to respect the provisions of the amended law n ° 78-17 of January 6, 1978 relating to personal data processing as it exists today and as it could be modified as well as the provisions of the European Data Protection Regulation 2016/679 of 27 April 2016, which will enter into force on 25 May 2018.
As a data controller, FlyToFlea is committed to take all necessary precautions to safeguard the personal data of the Customers.
As such, FlyToFlea is prohibited from communicating, in any form whatsoever, the personal data of Customers to a third party and will take all appropriate technical and organizational measures to keep that personal data confidential.
The personal data of the Clients will be processed, maintained and hosted by FlyToFlea on its computer equipment, exclusively in the European Union. Any transfer of personal data outside the EU will require the prior written consent of the Customer and / or data subjects, in accordance with applicable law.
Customers have the right to access, oppose, rectify and delete data concerning them by sending their request to: reclamations@flytoflea.com
FlyToFlea also undertakes to inform Customers without delay in case of leakage, attack or any other form of intrusion that may have a consequence on the personal data of the Clients.

Article 13 - Guarantees

FlyToFlea guarantees that the elements created and provided to the Customer respect the rights of third parties and are not illegal. FlyToFlea thus guarantees the Customer against any recourse or claim of any kind emanating from any third party in connection with the exercise of the rights granted under these Terms.

Article 14 - Insurance

FlyToFlea guarantees that is has a "damage" and "liability" insurance policy to guarantee all risks and possible damages related to its activity.

Article 15 - Applicable law and competent courts
